PLEASE READ THESE TERMS CAREFULLY BEFORE USING CLAIMTRACK PRO. BY CREATING AN ACCOUNT OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
These Terms of Service ("Terms") govern your access to and use of the ClaimTrack Pro software platform ("Service"), operated by Panashtech LLC ("Company," "we," "us," or "our"), a Florida limited liability company.
By accessing or using ClaimTrack Pro you confirm that you: (a) are at least 18 years of age; (b) have the legal authority to bind the business entity you represent; (c) have read, understood, and agree to these Terms and our Privacy Policy; and (d) are not prohibited from using the Service under any applicable law.
ClaimTrack Pro is a cloud-based field service and warranty lifecycle management platform for independent service contractors. The Service includes, but is not limited to:
Some features above are part of the product roadmap and may not be available on all plans or at all times. We reserve the right to modify, add, suspend, or discontinue any feature of the Service at any time. For material changes, we will provide at least 14 days notice by email.
You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at info@claimtrackpro.com if you suspect unauthorized access to your account. You are liable for all activity that occurs under your account.
ClaimTrack Pro uses role-based access control. The account Owner bears full responsibility for all activity by users they invite. Roles include:
Each plan includes a maximum number of active technician accounts: 3 for Starter, 6 for Pro, and 15 for Team. Exceeding these limits requires upgrading to a higher plan or contacting us for Enterprise pricing. Circumventing technician limits through any technical workaround is a material breach of these Terms.
Team plan subscribers may manage multiple business locations under one account. If you operate a franchise network and wish to grant franchisor-level access to account data, you must contact us at info@claimtrackpro.com to establish a written data-sharing agreement. You are solely responsible for ensuring any such sharing complies with applicable privacy law and your franchise agreements.
ClaimTrack Pro is offered on a month-to-month subscription basis. Current pricing:
All plans include a 14-day free trial. Your payment method is collected at signup but is not charged until the trial period ends. You may cancel any time before day 15 and you will not be charged. After the 14-day trial, the subscription fee for your selected plan applies.
All billing is processed through Stripe, Inc. By providing payment information, you authorize us to charge your payment method on a recurring monthly basis on the same date as your trial end. All prices are in US dollars. You are responsible for all applicable taxes.
Annual billing is available at a discount equivalent to 2 months free (approximately 16.7% savings). Annual subscriptions are billed upfront. Refunds for annual plans are available within the first 30 days only.
Upgrades take effect immediately. New features unlock within seconds and billing is prorated for the remainder of the current billing cycle. Downgrades take effect at the end of the current billing cycle. All data is preserved on downgrade.
You may cancel your subscription at any time from your account settings or by emailing info@claimtrackpro.com. Cancellation takes effect at the end of your current billing period. Your account and data are retained for 90 days after cancellation, during which you may reactivate and all data will be restored. After 90 days, all data is permanently deleted.
We do not offer refunds for partial months or unused features, except as required by applicable law or in cases of material service failure caused by ClaimTrack Pro. Refund requests must be submitted within 7 days of the billing event to info@claimtrackpro.com.
ClaimTrack Pro provides tools enabling contractors to offer extended warranty plans to customers at the point of job completion. The following terms govern this feature:
ClaimTrack Pro sends automated SMS messages via Twilio to technicians and customers as part of job dispatch, warranty alerts, and payment notifications. By using the Service:

We reserve the right to suspend or terminate accounts that violate these terms without prior notice. We will cooperate with law enforcement in any investigation of illegal activity facilitated through the Service.

The Service integrates with third-party providers. Your use of these integrations is subject to those providers' own terms and privacy policies:
ClaimTrack Pro is not responsible for outages, errors, data handling, or service interruptions caused by third-party providers.
ClaimTrack Pro, all associated software, design, logos, and content are the property of Panashtech LLC. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your active subscription period. You do not acquire any ownership rights in the Service, its code, or its design.
You retain full ownership of all data you input into the Service. You grant us a limited license to process that data solely for the purpose of providing the Service to you.
If you submit feedback, suggestions, or ideas about the Service, you grant us a perpetual, worldwide, royalty-free license to use that feedback without compensation or attribution to you.
We strive for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, infrastructure outages, or events outside our control may cause temporary unavailability. We will make reasonable efforts to provide advance notice of scheduled maintenance via email or in-app notification.
ClaimTrack Pro is not liable for any losses, missed jobs, or business damages resulting from Service unavailability. Your sole remedy for extended outages (more than 24 consecutive hours not caused by force majeure) is a pro-rated credit for the affected period, upon written request to info@claimtrackpro.com within 7 days.
Neither party shall be liable for delays or failures in performance caused by events outside their reasonable control, including but not limited to: acts of God, natural disasters, internet infrastructure failures, cyberattacks, actions of third-party service providers (including Stripe, Twilio, Supabase, or Vercel), government actions, or public health emergencies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PANASHTECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOST BUSINESS OPPORTUNITIES, OR CUSTOMER CLAIMS ARISING FROM YOUR USE OF THE SERVICE OR ANY EXTENDED WARRANTY YOU SELL. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU TO US IN THE THREE MONTHS IMMEDIATELY PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless Panashtech LLC and its officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any extended warranty or service plan you sell to your customers; (d) your violation of any applicable law; or (e) your violation of any third party's rights, including privacy rights of your customers.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings conducted in Miami-Dade County, Florida.
BOTH PARTIES WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Miami-Dade County, Florida, for claims involving intellectual property or data security.
We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the changes take effect. For non-material changes (such as clarifications or corrections), we will update the "Last Updated" date at the top of this document. Continued use of the Service after notice constitutes acceptance. If you do not agree to updated Terms, you must cancel your subscription before the effective date.
We may suspend or terminate your account immediately and without prior notice for: (a) material breach of these Terms; (b) fraudulent, illegal, or harmful use of the Service; (c) non-payment of subscription fees after reasonable notice; or (d) any activity that puts other users, our infrastructure, or third parties at risk.
You may terminate your account at any time in accordance with Section 4.6. Upon termination, your license to use the Service ends immediately. Provisions that by their nature should survive termination (including Sections 5, 8, 10, 13, 14, 15) will survive.
